Validity of General Terms & Conditions
The following General Terms and Conditions of Sale (GTC) govern the sale and delivery of goods through the online store www.nocciolaamoremio.com by Az. Agr. Nocciola Amore Mio, owned by Mattia Fontana, Via Cappelletti, 12, 12050 Cravanzana (CN), Italy (hereinafter referred to as “Nocciola Amore Mio”). By placing an order or registering as a buyer, the Customer expressly approves and accepts the GTC. The GTC, which may be modified at any time by Nocciola Amore Mio, are valid in the version in effect at the time of the order.
Product Catalogue and Prices
The items for sale are exactly those displayed in our online catalog and match, except for potential typographical errors, the product name and its features. The images are also realistic. However, for some items, the shape or type of container and/or packaging, as well as the label design, may vary. These variations are not considered substitutions or alterations of the product offered on this site.
There is no minimum order required to make a purchase: it is possible to buy even just one product. All prices listed on Nocciola Amore Mio are expressed in Euros and include VAT and any other applicable taxes. The prices are not binding. Price indications may be subject to typographical errors or technical issues. Nocciola Amore Mio reserves the right to reject orders resulting from pricing errors and to cancel the sales offer. Nocciola Amore Mio reserves the right to change the prices published on the website www.nocciolaamoremio.com at any time. The prices of products published at any given time override and replace previous prices and are subject to the actual availability of the products. The prices listed do not include shipping costs, which will be calculated separately during the checkout and payment process, after the user has entered their exact shipping address. The shipping cost varies depending on the weight of the purchased product and the destination city or locality. For domestic destinations, shipping costs are uniform throughout Italy but may increase if the product is delivered to Sicily, Calabria, Sardinia, or the smaller islands. Different shipping costs are expected for deliveries outside Italy, varying for EU and non-EU countries. Free delivery upon reaching a certain order quantity is not something users of the website www.nocciolaamoremio.com should expect. Ordered items are generally delivered by courier in special cardboard containers, with extra care taken for fragile items. Packages are always shipped via express courier with tracking, whether for domestic, EU, or non-EU shipments. A link will be provided to the customer to track their package online. The accompanying invoice for the order, if requested by the customer, or a receipt will be included in the package, detailing the purchased products and their prices. Sales are open to customers in Italy, the EU, and non-EU countries.
Terms of Payment
Once the desired quantity of merchandise has been selected, it will be displayed in the shopping cart. At this point, to proceed with payment, users can register by entering their details and creating a username and password. For subsequent purchases, as a registered user, it will be sufficient to log in to the site using the previously created username and password. Purchases on the site can also be made as a guest, where the user does not create a profile and instead enters their details during each new purchase process. By placing an order on the website www.nocciolaamoremio.com, the Customer declares that they have reviewed the terms of sale, the proposed payment methods, and the entire purchase procedure. The purchase price must be paid at the time of ordering through the available payment methods. In the case of partial deliveries, the purchase price is due for the portion of goods delivered. The merchandise remains the property of Nocciola Amore Mio until the purchase price has been paid in full. Any collection fees may be charged.
Payment Methods
The accepted payment methods are as follows:
- Credit cards, are accepted VISA, Mastercard, and American Express. Payments are processed on a secure server and through the aforementioned networks, via the payment provider STRIPE.
- PayPal, in this case, the payment will be processed through the PayPal platform, which will charge the amount to the linked card. The aforementioned cards are also accepted here.
- Bank Transfer, in this case, the order will be processed after receiving a copy of the payment receipt or confirmation of the bank credit. The bank details and payment instructions will be provided.
- Cash on Delivery, cash payments upon delivery are also accepted. The specific terms will be explained to the user during the online checkout process and selection of the payment method.
Shipping times
Delivery times are approximately 24/48 hours (counting only business days) from receipt of payment for orders shipped within Italy, while they are 4/5 business days for orders shipped within the European Union. For international and non-EU shipments, it is recommended to contact Nocciola Amore Mio before placing an order on the site. These are approximate times, as once the package is handed over to the carrier, the logistics responsibility shifts to the carrier. In some cases, delivery times may experience significant delays. Nocciola Amore Mio declines all responsibility related to the fulfillment of the indicated delivery times. All products sold on the site are available in stock, although especially during certain times of the year, low availability of an item or simultaneous orders may affect the actual online availability. Therefore, if the ordered volume exceeds the stock, delivery times may experience significant delays. Nocciola Amore Mio reserves the right to deliver and charge for reduced quantities compared to the original order. Within reasonable limits, Nocciola Amore Mio will promptly inform the buyer of any delivery delays or limited product availability. No right to compensation for damages exists in the case of limited product availability or delivery delays. If the delivery times are not met, the buyer may cancel the contract if, after 3 weeks from the initially expected delivery date, Nocciola Amore Mio fails to meet that deadline. The costs resulting from the failure to receive the goods by the customer will be borne by the customer. Since incomplete delivery address information generally prevents delivery, it is essential to provide a correct and complete delivery address (postal code, location, street, house number, building, door) when placing the order. Otherwise, delays in delivery and returns may occur. Additional costs arising from any shortcomings on the customer’s part will be charged separately.
Withdrawal right
Pursuant to Legislative Decree 196/2003 and European Regulation 679/2016 for consumer protection, the Customer may withdraw from the purchase contract within 10 days of receipt of the ordered goods without providing any reason. The withdrawal must be communicated via registered letter with return receipt to Az. Agr. Nocciola Amore Mio di Mattia Fontana, Via Cappelletti, 12, 12050 Cravanzana (CN), or by certified email (PEC) to the address mattia.fontana@arubapec.it. This communication must also be sent in advance by email to info@nocciolaamoremio.com and should clearly state the intention to cancel the purchase, attaching the original Invoice or Receipt.
The returned goods must be shipped without any damage or alteration and must be properly packaged. The return shipping costs are the responsibility of the buyer. The refund for the purchase price and initial shipping costs will be processed after the goods have been correctly returned.
The right of withdrawal is excluded in the case of perishable goods, items made to order or customized by Nocciola Amore Mio according to the customer’s specifications, or when delivery cannot be completed due to the customer’s absence at the delivery location, and the products are found to be altered or damaged due to the customer’s delay in collecting them.
Warranty
In the event of disputes raised by the buyer regarding the goods, they may be returned to Nocciola Amore Mio along with a specific explanation of the claim and the original Invoice or Receipt. In the case of defective goods, the buyer may choose between a replacement of the item, the delivery of a different item of the same value, or a refund equal to the purchase price of the goods.
The legal warranty rights are limited to the amount specified on the corresponding Invoice or Receipt.
The presence of deviations in the goods from the standards accepted by common commercial practice or minor differences attributable to technical reasons does not constitute a defect and, therefore, is not covered under the warranty.
The warranty is valid for a period of 2 years from the date the goods are received by the buyer.
Compensation for Damages and Liability
Nocciola Amore Mio is liable only for damages resulting from willful misconduct or gross negligence; liability for minor negligence is excluded. Unless otherwise provided by law, liability is limited to the amount specified on the Invoice or Receipt. Nocciola Amore Mio is not responsible for the unauthorized use of the buyer’s password by third parties. The customer is responsible for safeguarding their access credentials and assumes sole responsibility for their use. Therefore, after completing their session on www.nocciolaamoremio.com, registered users must log out if they have accessed their account.
Privacy
The buyer authorizes the processing and electronic storage of personal data provided during registration. These data will be used in accordance with applicable legal regulations to carry out payment procedures and will be shared with entities entrusted with performing such activities. The data may only be disclosed upon request by judicial authorities. Subscribing to the newsletter constitutes acceptance of receiving promotional information and offers from Nocciola Amore Mio. Nocciola Amore Mio expressly commits not to share these data with other companies. This consent to the electronic processing of personal data can be revoked at any time. The buyer has the right to obtain, free of charge, a copy of all personal data stored by Nocciola Amore Mio. The data controller and processor is Nocciola Amore Mio, represented by its Owner.
Jurisdiction
The exclusive jurisdiction is the Court of Cuneo. The applicable law to the contractual relationships between the parties is Italian law. The eventual invalidity of individual clauses of this contract does not affect the validity of the entire General Terms and Conditions (GTC). The invalid clause is replaced by a valid clause that most closely aligns with the intent of the invalid clause or by the regulations provided by law.
